H.1794 An Act relative to transport under Section 12(a)

This bill will clarify the current language in Chapter 123 Section 12(a) regarding emergency mental health evaluations. This will not change the current process that takes place under this section, which allows a family member to call a patient’s psychiatrist, physician, psychiatric nurse or other mental health professional to report behavior that is harmful to themselves or others and to have that person transported for an evaluation. This small change simply ensures that the mental health professional is empowered to authorize this transport either because of the emergency nature of the case or because a patient refuses the evaluation (this is a new bill).
